近年來,“代理退?!敝饾u成為保險市場中的一大隱患。不法分子打著“專業(yè)維權(quán)”的旗號,以非法牟利為目的,用“代理全額退?!薄熬S權(quán)退費”“保單升級”等為誘餌,通過網(wǎng)絡(luò)平臺、短信、電話營銷等方式發(fā)布“代理退保”信息,慫恿、誘導(dǎo)保險消費者委托其代為辦理退保業(yè)務(wù),從中收取高額手續(xù)費。達到索取退保手續(xù)費或獲取其他不正當利益的目的,形成“退保黑產(chǎn)”灰色產(chǎn)業(yè)鏈。

李女士因經(jīng)濟壓力考慮退保時,偶然在網(wǎng)上看到一則廣告,聲稱“專業(yè)團隊可幫您全額退保,成功率99%”。她聯(lián)系了對方,并按要求支付了3000元的“服務(wù)費”,同時還提供了身份證復(fù)印件、銀行卡信息等敏感資料。然而,當李女士多次催促對方辦理退保事宜時,對方卻以各種理由拖延,最后甚至直接失聯(lián)。此時,李女士不僅沒有拿到退款,還白白損失了3000元的服務(wù)費,追悔莫及。

4. 福建宣判“代理退保”定刑“敲詐勒索罪”

犯罪團伙通過網(wǎng)絡(luò)平臺發(fā)布“可辦理全額退?!毙畔?,謊稱擁有專業(yè)的退保團隊和法務(wù)支持,慫恿、誘導(dǎo)多名投保人委托該團伙進行代理退保,并教唆投保人以消極、對抗的方式應(yīng)對保險公司退保核查。
A criminal group advertised online, falsely claiming to have a professional team and legal support to secure “full insurance refunds”. They?lured policyholders into authorizing them to surrender policies, and instructed clients to resist insurance companies’ verification processes.
同時,犯罪團伙成員再以杜撰、虛增、偽造保險公司違規(guī)行為的方式編寫投訴信,并向福建銀保監(jiān)局投訴相關(guān)保險公司,從而達到逼迫保險公司退還投保人保險金的目的。最后,犯罪團伙、代理商按照約定比例分成。犯罪團伙的惡意投訴、逼迫退保,給保險公司帶來了直接的經(jīng)濟損失,也讓投保人失去了保險保障。
At the same time, they?fabricated complaints alleging regulatory violations by insurance companies. These complaints were submitted to the ?Fujian Supervision Bureau of China Banking and Insurance Regulatory Commission, ?with the aim?to pressure insurance companies into refunding premiums. The group then split the illicit gains with agents based on prearranged ratios. Their malicious tactics caused direct financial losses to insurance companies and stripped policyholders of critical insurance coverage.
最終,福建省福州市連江縣人民法院判決6名涉“代理退?!焙诋a(chǎn)不法人員犯“敲詐勒索罪”,判處拘役5個月(緩期8個月)到有期徒刑3年10個月不等的刑罰,并處2000元至1萬元不等的罰金;同時,將違法所得返還保險公司。
Six members of the group?were convicted of ?extortion by the ?Lianjiang County People’s Court in Fuzhou, Fujian??. Sentences ranged from criminal ?detention?of?five months (suspension for eight months)? to ?imprisonment of three years and ten months, with fines of ?2,000 to 10,000 yuan?. The court also ordered the restitution of illegal proceeds to the affected insurance companies.
